Misuse of Drugs Act definition
The Misuse of Drugs Act 1971 is an Act of the Parliament of the United Kingdom. It represents action in line with treaty commitments under the Single Convention on Narcotic Drugs the Convention on Psychotropic Substances and the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances. No such Treaty is however in any way binding on the UK Courts or Parliament and these have not been incorporated into UK law.
Offences under the Act include:
1. Possession of a controlled drug unlawfully
2. Possession of a controlled drug with intent to supply it
3. Supplying or offering to supply a controlled drug (even where no charge is made for the drug)
4. Allowing premises you occupy or manage to be used unlawfully for the purpose of producing or supplying controlled drugs
Drug Possession definition
Drug possession is the crime of having one or more illegal drugs in one's possession, either for personal use, distribution, sale or otherwise. Illegal drugs fall into different categories and sentences vary depending on the amount, type of drug, circumstances, and jurisdiction. A person has possession of drugs if he or she has actual physical control of the drugs (they have the drugs in their hands) or if the drugs are on that person. A person also has possession of drugs if he or she has the power and intent to control their disposition and use.
